General information

The privacy policy of this application regulates the use of the geolocation service that LAMBDA AUTOMOTIVE will provide to the EFI Asistencia customer. This service consists of a geolocation service to know in real time the geographical position of the user providing the assistance service, so that from the central to which he belongs they can assign new assistance services that are closer to the location and they can carry out the monitoring while the service is provided. Additionally, this privacy policy regulates the use of certain data related to the devices on which the application is installed and which are related to the device on which the application and/or its operating system are running.

The use of the service is subject to all the notices, use regulations and instructions of Regulations (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons in the processing of personal data and the free circulation of these data and the Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, as well as other laws that may be applicable. The client accepts these laws and he will be solely responsible for direct or indirect damages that may arise from the illegal use of the service to violate fundamental rights, including the unauthorized extraction and/or the reuse of information from the service, whatever the purpose that he pursues.

Privacy Policy

On behalf of LAMBDA AUTOMOTIVE we inform you that we process the information provided by the mobile applications of our EFI Asistencia geolocation suite, in order to offer the CLIENT the geographical location of the users providing the assistance service.

The data provided on the location of the users providing the assistance service will be kept for (1) one year to maintain a history of the trips in order to optimize routes. This period may be modified if established by law or at the request of the CLIENT up to a maximum of two years or a minimum of six months.

The data will be stored and encrypted to safeguard secrecy and confidentiality and will not be transferred to third parties, except in cases where there is a legal obligation or by judicial prescription.

Users providing the assistance service have the right to obtain confirmation about whether our company is treating their personal data. Therefore they have the right to access to the data, rectify inaccurate data or request its deletion when the data is no longer necessary for the purposes for the data were collected.

Purpose

  • To be able to follow up on the users who provide the assistance service while providing the service. This position, in the cases in which the CLIENT authorizes it, can also be shared with the Assistance/Insurance Company.
  • Automatic service assignment processes.
  • Processes of automatic sending of conditions (arrival at the place of assistance) based on the position of the users providing the assistance service.

Legal base

Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, related to the protection of natural persons with regard to the processing of personal data and the free circulation of these data. Law 34/2002, of July 11, on services of the information society and electronic commerce.

Recipients

Except for legal prescription or authorization of the CLIENT, we do not transfer data to third parties.

Duration

As it is a route management solution, storage is for (1) one year, and that period may be modified if so established by law or at the request of the CLIENT up to a maximum of two years or a minimum of six months (art. 5 of Law 25/2007, of October 18, on the conservation of data relating to electronic communications and public communications networks).

Security breaches

When personal data security violations occur in our application, such as theft or improper access to personal data, the Client will be notified to the Spanish Data Protection Agency within seventy-two (72) hours about the security violations, including all the information necessary to clarify the facts that would have given rise to improper access to personal data.

Additional information

The user may at any time request additional information about their personal data ("second layer") at the same email address that we provide in order to exercise their rights.

Rights

The user may exercise the ARCO rights of access, rectification, cancellation and/or opposition, as well as the right to "oblivion" and portability. To do this, he can write to our e-mail address dpo@lambdamotive.com or to our postal address by going to the Data Protection Delegate of our company, and if he does not obtain satisfaction of his right, he can file a claim with the control authority in www.aepd.es.
